In an unfortunate turn of events you are left reeling from the loss of a loved one. You are still in the process of grief when you notice the portrait depicting rolling hills with the sun setting over the horizon. It was their favourite piece of art which, together with the rest of their belongings, must be awarded to the heirs the estate.
To curtail the stressors above it is important to tend to proper estate planning and the drafting of a legal and valid will which serves to instruct the executor with regard to the divestment of your estate.
Once the deceased has passed away the family must report the death to the Department of Home Affairs where a death notice must be completed and a death certificate will be issued.
The executor will then go about drafting and collating all the documents for submission at the relevant Master’s office. Although the Master has indicated a 6 to 8 week waiting time, it is important to note that the time period will usually be extended due to the backlogs and workload of the Master’s Office.
After the letter of executorship has been issued and collected the estate must be advertised for the attention of any creditors to said estate.
A draft liquidation and distribution account must be drawn and presented to the Master. This account encompasses all assets, liabilities, taxes, income and expenses necessary for the proper administration of the estate. Once the Master has confirmed same, the liquidation and distribution account will be advertised again.
The Master will then approve the final liquidation and distribution account as the penultimate step in administration.
For completion of the process, the executor is required to divest all assets and settle all liabilities to the satisfaction of the Master.
